1. About Us

PolicyMatcher is a brand operated by Marketcall Inc, a California corporation. Throughout these Terms and Conditions, "we," "us," "our," and "the Company" refer to Marketcall Inc. "PolicyMatcher" refers to the website and marketplace services offered at PolicyMatcher.com.

Please read these Terms and Conditions carefully before using PolicyMatcher.com. By accessing or using our website or services, you confirm that you accept these terms and agree to comply with them.

2. About Our Service

PolicyMatcher operates a business-to-business pay-per-call and pay-per-lead marketplace that connects consumers who are shopping for insurance with licensed, independent insurance agents and agencies ("Agents"). PolicyMatcher does not sell insurance to consumers, is not an insurance carrier or broker, and does not make insurance coverage decisions. All insurance products and services are offered solely by the independent licensed Agents who participate in the marketplace.

Agents are the paying customers of PolicyMatcher. Consumers who submit inquiries through PolicyMatcher do so to be connected with Agents who may be able to assist them; consumers are not charged for this connection service.

These Terms govern your use of PolicyMatcher.com. Agents using the marketplace platform are also subject to any applicable Agent Service Agreement entered into at account registration. Our Privacy Policy explains how we handle personal data collected through our website and services.

3. Agent Eligibility and Licensing

To register as an Agent on PolicyMatcher, you must:

  • Be a licensed insurance agent or agency in good standing in each state where you intend to accept calls or receive leads;
  • Maintain all required state insurance licenses for the insurance lines you advertise on PolicyMatcher;
  • Comply with all applicable federal, state, and local laws and regulations, including those governing insurance sales, telemarketing, and consumer protection;
  • Be at least 18 years of age and have the legal authority to enter into binding contracts.

By registering an Agent account, you represent and warrant that you meet all eligibility requirements and that all information you provide is accurate and current. You agree to promptly notify us if your licensing status changes. We reserve the right to suspend or terminate any account for failure to maintain required licenses.

4. Prepaid Account Funding and Billing

PolicyMatcher operates on a prepaid billing model. Agents must fund their account balance in U.S. dollars (USD) before receiving calls or leads. The following terms govern billing:

4.1 Account Funding

Agents add funds to their account using a valid payment method accepted by PolicyMatcher. Funds are credited to the Agent's account balance immediately upon successful payment processing. Minimum deposit amounts may apply and will be disclosed at the time of funding.

4.2 Per-Call and Per-Lead Charges

Agents set their own bid price per qualified inbound call or per delivered lead, within any minimum or maximum bid ranges established by PolicyMatcher from time to time (for example, $15–$65 per call, subject to change). Charges are deducted from the Agent's prepaid account balance at the bid rate in effect at the time a qualifying call or lead is delivered.

4.3 Qualifying Calls

A call is billable when it meets the Agent's campaign criteria, including any minimum call duration threshold set by the Agent in their campaign settings. Calls that do not reach the minimum duration threshold, or that are otherwise excluded under the Agent's campaign filters, are not charged. Duration thresholds are set by the Agent and PolicyMatcher does not guarantee the quality of conversations.

4.4 Qualifying Leads

A lead is billable when it is delivered to the Agent matching the Agent's campaign targeting criteria. PolicyMatcher delivers leads in real time or in batches as agreed; we do not guarantee that delivered leads will convert to sales.

4.5 Account Balance

Agents may view their current account balance, charge history, and transaction records through the Agent dashboard. PolicyMatcher may pause call and lead delivery if an Agent's account balance falls below a minimum threshold, as disclosed in the Agent dashboard.

5. Refunds, Cancellations, and Dispute Resolution

PolicyMatcher's refund and dispute policy is designed to be fair to Agents while maintaining the integrity of the marketplace.

5.1 Disputing a Call or Lead

If an Agent believes a charged call or lead did not meet their stated campaign criteria (e.g., wrong geographic area, wrong insurance type, duplicate lead, or call did not reach the minimum billed duration), the Agent may submit a dispute through the Agent dashboard within [X] business days of the charge. Disputes submitted outside this window will not be considered.

To submit a dispute, the Agent must provide: the call or lead ID, the date of the charge, the campaign it was applied to, and a clear description of why the charge does not meet campaign criteria. PolicyMatcher will review disputes and respond within [X] business days of receipt.

5.2 Dispute Outcomes

If PolicyMatcher determines that a disputed call or lead did not meet the Agent's campaign criteria, the charge will be reversed and the amount credited back to the Agent's prepaid account balance. Approved disputes are issued as account credit only and are not refunded to the original payment method, except as described in Section 5.4 below.

Disputes based solely on consumer quality, contact difficulty, or failure to convert to a sale are not eligible for credit, as PolicyMatcher does not guarantee sales outcomes.

5.3 Account Cancellation

Agents may cancel their PolicyMatcher account at any time by submitting a cancellation request to info@policymatcher.com. Upon cancellation, all active campaigns will be paused. Cancellation requests will be processed within [X] business days.

5.4 Unused Account Balance on Cancellation

Upon account cancellation in good standing (i.e., no outstanding policy violations or unresolved disputes filed against the account), any remaining prepaid account balance will be refunded to the original payment method used for the most recent funding, less any applicable processing fees, within [X] business days of account closure. Balances below a de minimis threshold of $[X] may be forfeited as administrative costs. PolicyMatcher reserves the right to withhold a refund of any balance if the account is terminated for cause, including violation of these Terms.

5.5 No Chargebacks

Agents agree to use the dispute process described in this Section before initiating any payment dispute or chargeback with their card issuer or payment provider. Chargebacks filed without first exhausting the dispute process may result in account suspension and may be contested by PolicyMatcher.

6. Acceptable Use

Agents and all website users agree to use PolicyMatcher only for lawful purposes and in accordance with these Terms. You must not:

  • Misrepresent your licensing status, agency affiliation, or the insurance products you are authorized to sell;
  • Misrepresent coverage terms, premiums, benefits, or eligibility to any consumer contacted through PolicyMatcher;
  • Violate the Telephone Consumer Protection Act (TCPA), the Telemarketing Sales Rule, applicable state telemarketing laws, or any insurance department regulations governing consumer contact;
  • Use consumer information obtained through PolicyMatcher for any purpose other than the legitimate pursuit of the insurance inquiry for which the lead was purchased;
  • Sell, transfer, or share consumer lead data obtained from PolicyMatcher to unauthorized third parties;
  • Attempt to circumvent PolicyMatcher's billing systems or obtain calls or leads without proper payment;
  • Introduce malware, viruses, or other harmful code to PolicyMatcher's systems;
  • Attempt unauthorized access to PolicyMatcher's servers, databases, or other infrastructure;
  • Use any automated system, scraper, or bot to access PolicyMatcher other than as expressly permitted by us.

We reserve the right to investigate suspected violations and to suspend or terminate accounts found in breach of these Terms. We will cooperate with law enforcement authorities where required by law.

7. Account Security

You are responsible for maintaining the confidentiality of your account credentials, including your username and password. You must not share your credentials with any third party. You are responsible for all activity that occurs under your account. If you suspect unauthorized access to your account, notify us immediately at info@policymatcher.com. PolicyMatcher will not be liable for any loss or damage arising from unauthorized use of your account credentials.

8. Intellectual Property

PolicyMatcher.com and all content on it — including text, graphics, logos, software, and data compilations — are owned by or licensed to Marketcall Inc and are protected by applicable United States copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from our content without our prior written permission.

9. Third-Party Links

Our website may contain links to third-party websites. These links are provided for convenience only. We have no control over the content of those websites and accept no responsibility for them or for any loss or damage that may arise from your use of them.

10. Disclaimer of Warranties

THE POLICYMATCHER WEBSITE AND MARKETPLACE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW. MARKETCALL INC DOES NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR TIMELINESS OF ANY CONTENT ON THE WEBSITE.

POLICYMATCHER DOES NOT GUARANTEE THAT ANY AGENT WILL RECEIVE A MINIMUM NUMBER OF CALLS OR LEADS, OR THAT ANY CALL OR LEAD WILL RESULT IN A SALE OR POLICY PLACEMENT.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE CALIFORNIA AND FEDERAL LAW, MARKETCALL INC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOSS OF DATA, LOSS OF BUSINESS, OR LOSS OF GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE POLICYMATCHER'S WEBSITE OR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE EXTENT PERMITTED BY LAW, MARKETCALL INC'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER OR RELATED TO THESE TERMS SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO POLICYMATCHER IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

NOTHING IN THESE TERMS LIMITS OR EXCLUDES LIABILITY FOR FRAUD, GROSS NEGLIGENCE, OR ANY OTHER LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE CALIFORNIA OR FEDERAL LAW.

12. Indemnification

You agree to defend, indemnify, and hold harmless Marketcall Inc and its officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising out of or relating to: (a) your use of PolicyMatcher in violation of these Terms; (b) your violation of any applicable law or regulation, including insurance licensing laws and the TCPA; (c) any claim by a consumer arising from your communications with or treatment of that consumer; or (d) any misrepresentation you make in connection with the PolicyMatcher marketplace.

13. Governing Law and Venue

These Terms and any disputes arising out of or related to them or to PolicyMatcher's services shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict-of-laws principles. Any legal action or proceeding arising under or relating to these Terms shall be brought exclusively in the state or federal courts located in Los Angeles County, California, and you hereby consent to the personal jurisdiction of those courts.

14. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will revise the "Last Updated" date at the top of this page. We may also notify registered Agents by email. Your continued use of PolicyMatcher after any changes take effect constitutes your acceptance of the revised Terms. If you do not agree with the revised Terms, you must stop using PolicyMatcher and may cancel your account as described in Section 5.3.
